Air Fee Schedule
The new Application Fee Schedule for all permit applications is effective on July 1, 2020.
The Air Program with the Nevada Division of Environmental Protection presented a fee regulation amendment to the State Environmental Commission on October 2, 2019 and the Legislative Commission on December 30, 2019. The proposed changes were approved at both hearings, have been filed with the Secretary of State, and are now in effect. These changes update the Air Program’s approach to how fees are assessed and redistribute the fees across the regulated industry to reflect workload and resources required to implement NDEP’s Air Program.
The changes include, but are not limited to, the following:
- Most permit application fees have changed and are effective July 1, 2020. Make sure you submit the correct fee along with your application. Please review the Application Fee Schedule.
- Many permit application fees are calculated based on total number of Emission Units and Insignificant Activities affected in the permitting action.
- For most applications, a 10% non-refundable fee is included in the application fee to cover the costs associated with the completeness review process. If the application is deemed incomplete, 10% of the total application fee paid will be retained by the Air Program. Please review the appropriate Permit Application Completeness Checklist located on our Download Permit Forms page prior to submitting your application.
- There is a new $1,000 application fee (and application) associated with each of the following actions: Insignificant Activity Determination, Confidentialy Request, Class II Applicability Determination, and Class I Notitification of Authorized Change.
- An Administrative Amendment fee is $1,000.
- A Change of Location, for both temporary and stationary sources, is $200 per Emission Unit. An application has been developed for a stationary Change of Location.
- For Class II General Permit applications, a New application is $1,500 for temporary sources and $500 for stationary sources. Only stationary sources may revise their permit, and the fee is $250.
- For stand-alone Class II Surface Area Disturbance (SAD) applications, the fee for New/Renewal ranges from $1,000-$5,000, and a Revision is $500.
- Applications for an Administrative Renewal of a Class I or Class II Stationary Air Quality Operating Permit will be accepted starting January 1, 2020.
- The Administrative Renewal application fee is $5,000 for a Class I and $2,000 for a Class II operating permit.

- A facility may submit an Administrative Renewal if all of the following items have been met:
- The facility has one or more Class I or Class II operating permits;
- The facility has been issued a new or renewed operating permit that was issued on or after January 1, 2018;
- The renewal does not require changes to the existing operating permit; and
- At the time of the operating permit renewal request, an environmental evaluation and an air pollutant dispersion model that were submitted within five years of the request are deemed adequate by the Air Program.

- Annual emision fees for Class I sources have been eliminated.
- The new annual maintenance fee schedule is effective on January 1, 2020; there is a 3-Year Phase-In for all annual maintenance fees.
