        Construction Stormwater Permit

         

        Notice: The 2015 Construction Stormwater General Permit (NVR100000) has been administratively continued while a permit renewal is being drafted. Renewal notices will be mailed once the new permit has been issued.

        The objectives of the Construction Stormwater General Permit NVR100000 is to control and reduce pollution to Waters of the State that meet the definition of Waters of the United States (WOUS). NDEP requires owner/operators to obtain a Construction Stormwater Permit if the project will discharge to a WOUS and meets the following conditions:

        1. Project will disturb one (1) or more acres , or
        2. Project will disturb less than one (1) acre but is part of a larger common plan for development or sale that will ultimately disturb one (1) acre or more.

        If NDEP determines that a project less than one (1) acre in size will impact receiving waters or its tributaries within a 1/4-mile radius of the project, the owner/operator of the project will also be required to obtain a construction stormwater permit.

        If the construction site requires a construction stormwater permit, the owner/operator must complete a Notice of Intent (NOI) for coverage under the Construction Stormwater General Permit NVR100000. After filling in the required information, you will need to print out the confirmation page, have an authorized person sign it, then send the confirmation page and a $200 filing fee to NDEP at the address listed below.

        NDEP recommends that you read the 2015 Construction Stormwater General Permit and Fact Sheet for more detailed information about the requirements of the permit.

        Construction activity defined under Category X of 40 CFR §122.26(b)(14). Stormwater Discharge Associated with Construction Activity, applying to projects disturbing at least one acre, or will disturb less than one (1) acre but are part of a larger common plan for development or sale that will ultimately disturb one (1) or more acres.
